Privacy Policy

Well Played, LLC provides market research services to third party clients (“Clients”).  We use online surveys, in person focus groups as well as other information gathering methods to collect data relevant to our Client’s needs (the “Market Research Activities”).   The terms and conditions set forth in this Privacy Policy apply to all Market Research Activities.

Participant Information

By participating in any of our Market Research Activities you will provide us, or we will automatically collect, information about you (the “Participant Data”).   We treat all Participant Data as confidential and do not use it for any purpose other than as provided in this Privacy Policy. 

If you are a resident of the European Union, you hereby consent and acknowledge that your Participant Data will be transferred outside of the European Economic Area (the “EEA”) using the Standard Contractual Clauses which provide for safeguards for personal data exported from the EEA. 

Participant Data includes, but is not limited to

Personal information you provide about yourself:

  • Name

  • E-mail address(es)

  • Phone number(s)

  • Birth month and year

  • Education and Employment experience

  • City

  • Household information

  • Etc.


Gaming information you provide that relates to how you use games or gaming products:

  • Genres played

  • Games played

  • Platforms owned

  • Gaming motivations

  • Gaming preferences

  • Etc.

Participant Data also includes, if applicable, photos or videos of the research if the Market Research Activities are performed in person and recorded on video. 


Use of Participant Data

We use Participant Data in the course of our normal business operations including recruiting for research and understanding larger trends in the market. We use your personal information only to recruit for research and do not share this with any third party without your express consent. We do not sell, trade, share or rent your personal information to others. Ever.

We do look at the gaming information to provide information on trends and occasionally share this through contractual arrangements with affiliates, service providers, partners or other third parties. This is never tied to your personal information and is very rare. Significantly, our clients rely on our services for Market Research and that includes the Gaming information your provide in the course of applying for and participating in research.    

Participant Data Security

We are committed to keeping Participant Data secure, and take reasonable precautions to protect it from loss, misuse or alteration. 

We have implemented measures designed to secure Participant Data from accidental loss and from unauthorized access, use, alteration, and disclosure.  Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect Participant Data, we cannot guarantee the security of your personal information transmitted over the Internet. Any transmission of personal information is at your own risk.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Contacting The Participant Pool

We maintain a database of Participants for the purpose of being able to invite Participants to participate in future Market Research Activities (“Participant Pool”).  We may contact you through email or mobile message, or other means through which you have consented for us to contact you, to participate.  We may have to obtain additional information to determine whether you qualify for any such future Market Research Activity.

Disclosure of Participant Data​

Only our authorized employees, agents, vendors, contractors or partners carrying out authorized business functions for us are allowed to access Participant Data.  Additionally, we may share the trends in the data with our Clients but never your personal information unless we receive your express consent to share.

However, under certain circumstances we may disclose Participant Data to third parties including:  (a) where required by law or court order; (b) in the event of a sale, merger, liquidation, or acquisition of our company where the acquiring party agrees to be bound by the terms of our Privacy Policy; and (c) where the Market Research Activity clearly states that the Participant Data will be disclosed to a third party.


Participant Data Retention

We will retain Participant Data only for as long as is necessary for the purposes set out above, unless a longer period is required or permitted under applicable law or is needed to resolve disputes or to protect our legal rights. Under certain circumstances, you have the right to have certain of your Participant Data erased (see Rights of Individuals in the EEA below). We will securely delete your Participant Data after it is no longer needed for those purposes it was collected.

Participating in our Market Research Activities is voluntary. If you do not agree with the terms and conditions laid out above, you may choose not to participate in the activity. If you choose to participate, you can withdraw your consent at any time by deleting your account or contacting us at


Independent Services

We may use independent websites and services to support our Market Research Activities.  Platforms like Zoom or Surveygizmo are tools we license to complete the research.  We do not have control over the content of external websites, or the security practices or policies of such independent parties or sites.  Any personal information you provide on independent websites or to independent services are subject to their privacy policies.  Please read their privacy policies before providing them with personal information.



We do not market our Market Research Activities directly to children under the age of thirteen (13).  Participants are not permitted to sign up for an account or participate in studies if under 13.  Therefore, we do not knowingly collect personal information under any circumstances from people under the age of thirteen (13).  In the event we become aware that we have collected information from anyone under the age of thirteen (13) we will promptly delete such data.

Opting Out

While we hate to see any Participant disengage from our Participant Pool, if you wish to be removed from our database and not contacted for future Market Research Activities please contact us through


California's "Shine the Light" law (Civil Code Section § 1798.83) permits Participants who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
